Terms and Conditions of Business
Working Standards: We strive to complete all operational works whether arboricultural, grounds or gardening work to the highest standards. All tree surgery operational works are carried out in accordance with British Standards guidance: BS:3998 – Recommendations for Tree Work (unless instructed otherwise by and agreed with the client). All specifications and pricing are included in our quotations.
Insurance: Works covered by a £10 million Public Liability Insurance and £10 million Employers Liability Insurance. Certificate copies are available on request.
Amendments to Works: Any alterations to our quotations will be made in writing and agreed upon before commencement of works. Changes to the site conditions from the initial survey may invalidate the estimate. Any changes will be agreed prior to commencement of works.
Acceptance and Cancellation of Works: Upon acceptance of our quotation, a contract is formed between you (the Client) and us. Clients have the Right to Cancel known as the “Cooling off Period” – the client has 14 days to cancel the contract (in writing) from the acceptance date. If within the 14-day period, you instruct us to carry out any of the works in the quotation, you will have waived your right to this cooling off period.
Cancellation of instruction to carry out works must be made in writing. In the event of cancellation at short notice, costs may be proportionally incurred by the client. A late cancellation policy will be sent as a separate document along with your quotation. In the event we have purchased materials or incurred any costs for an accepted quote which has been cancelled, we may seek to recover these costs in their entirety.
Stump Grinding: Stump removal is carried out with the use of a stump grinding machine. Stumps are ground as far below ground level as we are able. We do not chase roots from the stump unless arrangements and costs are made and agreed with the client beforehand. Debris from stump grinding is used to backfill the resulting hole. If removal of the chippings is required, this must be agreed at the quoting stage. Should hazardous material such as asbestos be discovered in the ground during stump grinding operations, work will cease immediately. The client agrees to settle our invoice, hire a specialist contractor to deal with the hazardous waste and meet the costs incurred.
Measurements: All specified measurements are classified as approximate
Tree Protection Orders: Any preservation order relative to trees specified in the estimate will be dealt with by us unless agreed otherwise.
Disposal of Waste: Unless otherwise stated in the quotation, all waste will be removed from site. Removed waste is recycled as per our ‘Sustainability and Environmental Practices Statement’.
Should the client require logs left, e.g. for firewood, these are not cut to a specific size unless requested at the quoting stage. In the event that specific sizes are requested after the quotation is accepted or during the course of works being carried out, additional costs will be charged and agreed before this work is actioned.
Access via Neighbouring Properties: Sometimes work requires access via a neighbours property. Clients agree to inform their neighbours of their intention to carry out works and arrange access.
Collateral damage to Client property: Whilst our staff always work with care, our work can entail the carrying of large amounts of material backwards and forwards over lawns and past buildings etc. Please ensure any particularly vulnerable surfaces, such as white walls, are adequately protected (builder’s polythene works well) and fragile objects are moved out the way, (such as pots etc.). Our staff are of course happy to move heavier objects for Clients. Lawns will recover quickly, but very wet weather can give rise to muddy conditions. We can provide boards to protect the lawn, however, this is not a standard procedure and will need to be agreed at time of quoting – this may incur an additional cost. Complaints: If you should have any cause for complaint regarding our work, please contact the office within 7 days and we will endeavour to correct the situation in a quick and timely manner. Our full complaints procedure is available on request.
Payment: The office will invoice jobs upon completion. For ‘one-off’ jobs, whether Garden or Tree Surgery works, the Team Leader on site will ask you to sign-off on their job sheet to confirm your satisfaction. If you have any queries, please raise these before signing-off the work. If you are not present upon completion of the work, the office will contact you for confirmation of your satisfaction. For regular maintenance contracts, invoices will be sent monthly after the last visit for each month has been completed. Payments must be made within 7 days of the invoice date unless otherwise agreed. Payments may be made by bank transfer, directly over the phone to the office by Debit or Credit Card or via the payment link on your invoice.
VAT is chargeable at the current rate. Our VAT number is: 142 2722 33 and is shown on all quotations and invoices.
Client Data Protection: We aim to protect your personal data in accordance with GDPR requirements and not to directly market our services to you without your prior permission to do so. Personal information is only used for the purposes of completing your contracted works. We do have to share some details with Local Authorities when making an application to undertake works on protected trees. Please refer to our full privacy policy for further details.
Staff Breaks: Our employees are entitled to reasonable rest breaks during the day. Typical break times are a 15 minute break within a half day/4 hour visit or a 15 minute break and 30 minute lunch break within a full day visit. These are built into our scheduling and do not affect the timeframe or cost of the visit.
